Acceptance of Terms and Conditions
The terms and conditions below (the “terms”) are what govern your use of the 30 Day MCAT website on the Internet and World Wide Web. These terms are a legal contract between you (“the Client”) and 30DayMCAT.com and it’s advertisers/sponsors, collectively known as 12215926 Canada Inc. (“we” or “us”.) They govern your access to, and your use of our website, which is located at 30DayMCAT.com (the “site”). These terms also govern your use of any services and products we provide on the site including but not limited to the 30 Day MCAT Course (the “Services”). If you do not agree with any of these terms, please do not access or otherwise use this site and/or our services and products.
Your use of this site, services and/or products on this site means that you agree to abide by each of the terms below. If you continue to use the site after such changes have been posted, it means that you agree to the new terms, even if you have not reviewed the changes. Therefore it is your responsibility to check the terms of use posted here periodically for updates and changes.
Services Provided
Your purchase may include access to digital educational content and services, as well as physical educational materials. Digital Services may include online course materials, videos, audio content, downloadable resources, webinars, coaching sessions, community access, and other related educational services, as described on the applicable order page or sales communication at the time of purchase.
Certain purchases also include physical products, such as printed books or workbooks. Physical materials are shipped to the mailing address provided at checkout or during the enrollment process. Shipping times may vary, and delivery of physical materials does not affect access to digital Services.
Access to the digital Services is provided electronically via login credentials associated with the email address used during enrollment. To activate access, you are required to create an account on our platform and confirm your acceptance of these Terms and Conditions before completing the purchase process.
You agree not to share your login credentials, passwords, call-in numbers, or protected links with any third party. Unauthorized sharing may result in suspension or termination of access without refund.
Payment
You agree to pay the purchase price for the Services selected at checkout or as agreed during enrollment. Prices and payment terms are disclosed prior to purchase.
Certain Services may be offered as a one-time payment or as part of a payment plan consisting of an initial payment followed by recurring installments. By completing your purchase, you authorize us to charge the payment method provided for the applicable amounts and schedule disclosed at the time of purchase.
You are responsible for any fees or charges imposed by your financial institution, including overdraft, over-limit, or insufficient funds fees.
If a payment is declined or a scheduled payment fails, access to the Services may be suspended until payment is resolved. Continued non-payment may result in termination of access without refund, in accordance with our Refund Policy.
Refund Policy
All purchases are final and non-refundable. Due to the digital nature of our educational programs and immediate access to proprietary materials, we do not offer refunds, credits, or exchanges under any circumstances.
Physical products, if included with a purchase, are non-refundable. If a physical product arrives materially damaged or defective, 30DayMCAT.com may, at its sole discretion, offer a replacement. Replacement of physical products does not entitle the purchaser to a refund, credit, or partial refund.
Access to the Program, including digital course content, online materials, and any associated resources, constitutes delivery of the Services. Once access is provided, the Program is considered delivered in full, regardless of whether the materials are downloaded, viewed, or used.
This no-refund policy applies to all purchases, including one-time payments, payment plans, and any bundled digital or physical materials. Cancellation, non-attendance, failure to complete the Program, dissatisfaction with results, or removal from the Program for violation of these Terms or non-payment does not entitle you to a refund.
By purchasing the Services, you agree not to initiate any chargeback or payment dispute with your payment provider without first contacting 30DayMCAT.com at [email protected] to attempt to resolve the issue.
If you initiate a chargeback, payment reversal, or dispute for any reason after accessing the Services, we reserve the right to immediately suspend or terminate your access to all Services without notice.
You acknowledge that access to digital content constitutes delivery of the Services, and this Agreement may be submitted as evidence to the payment processor or financial institution to contest any chargeback or dispute.
Success Disclaimer
30DayMCAT.com does not guarantee or promise any specific MCAT score, results, acceptance outcome, or level of success. Your results depend on many factors, including your individual effort, prior knowledge, study habits, consistency, test-taking skills, and other factors beyond our control.
By using our Services, you acknowledge that we make no representations, warranties, or guarantees regarding specific outcomes or results.
Educational Disclaimer
The Services are provided for educational and informational purposes only. Nothing contained in the Services constitutes academic, medical, legal, or professional advice. You are solely responsible for how you use the information provided, and 30DayMCAT.com disclaims any liability arising from reliance on the Services.
Term and Access Duration
Unless otherwise stated at the time of purchase, access to the Program and associated Services is granted on a lifetime basis. “Lifetime access” refers to access for as long as the Program and Services remain available and supported by 30DayMCAT.com.
We reserve the right to suspend or terminate access to the Services at any time if you fail to make required payments, violate these Terms and Conditions, misuse the Services, or engage in abusive, harassing, defamatory, or unlawful conduct toward 30DayMCAT.com, its team members, or its community.
Termination or suspension of access does not entitle you to a refund and does not relieve you of any payment obligations incurred prior to termination.
Lifetime access does not guarantee uninterrupted availability, future updates, continued hosting of any specific feature, lesson, platform, or format, or indefinite access to any individual component of the Services.
Intellectual Property
All content and materials provided by 30DayMCAT.com, including but not limited to course materials, videos, lessons, workbooks, study guides, text, graphics, logos, trademarks, and other proprietary content (collectively, the “Content”), are owned by or licensed to 30DayMCAT.com and are protected by intellectual property laws.
Subject to your compliance with these Terms and Conditions, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Content for your personal, non-commercial educational purposes only.
You may not copy, reproduce, distribute, share, sell, sublicense, modify, or create derivative works from the Content without prior written consent from 30DayMCAT.com. Unauthorized use of the Content may result in termination of access and may subject you to legal action.
Audio, Video, & Testimonial Release
By voluntarily submitting or sharing any testimonials, reviews, feedback, photos, videos, audio recordings, or written statements with 30DayMCAT.com (including via email, text message, website submission, social media, or other communication channels), you grant 30DayMCAT.com permission to use, reproduce, publish, display, and distribute such content for marketing, promotional, educational, or informational purposes.
This permission includes use on our website, social media platforms, advertisements, and other marketing materials. You understand and agree that no compensation will be provided for such use and that all submitted content may be used without further approval.
In addition, if you voluntarily participate in any recorded coaching sessions, trainings, or other recorded interactions, you consent to the recording and use of your name, voice, likeness, or statements in accordance with this section. All recordings and submitted materials are the exclusive property of 30DayMCAT.com.
User Conduct & Relationship
Nothing in these Terms and Conditions shall be construed to create a partnership, joint venture, employment, agency, or fiduciary relationship between you and 30DayMCAT.com.
Neither party has the authority to bind or obligate the other in any manner, and each party remains independent and responsible for its own actions.
Non-Use of Services
Your failure to access or use the Services after purchase does not cancel, void, or otherwise affect your obligations under these Terms and Conditions.
Modification of Terms
We may update or modify these Terms and Conditions from time to time. Any changes will be effective immediately upon posting the updated Terms on our website.
Your continued use of the website or Services after any changes are posted constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for updates.
Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms and Conditions without the prior written consent of 30DayMCAT.com. Any attempted assignment in violation of this section is void.
30DayMCAT.com may assign or transfer its rights and obligations under these Terms at any time, including in connection with a merger, sale, or transfer of assets.
Third Party Beneficiaries
These Terms and Conditions are for the benefit of you and 30DayMCAT.com only and do not create any rights or remedies for any third party.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.
Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or the Services shall be governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
The parties agree to first attempt to resolve any dispute informally and in good faith. If a dispute cannot be resolved informally, either party may elect to have the dispute resolved through binding arbitration in Ontario, Canada, in accordance with applicable arbitration rules.
Notwithstanding the foregoing, 30DayMCAT.com retains the right to seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
Limitation of Liability
To the maximum extent permitted by law, 30DayMCAT.com shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the website or Services, even if advised of the possibility of such damages.
In no event shall 30DayMCAT.com’s total liability to you for any claim arising out of or relating to the Services exceed the total amount paid by you to 30DayMCAT.com for the applicable Services.
Indemnity
You agree to indemnify, defend, and hold harmless 30DayMCAT.com and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms and Conditions, or any content you submit, post, or share that results in liability to a third party.
Force Majeure
30DayMCAT.com shall not be liable for any delay or failure to perform its obligations under these Terms and Conditions due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, government actions, labor disputes, power or internet outages, or technical failures.
In such events, performance will be excused for the duration of the disruption.
Waiver
Our failure to enforce any right or provision of these Terms and Conditions does not constitute a waiver of that right or provision or of any other rights or provisions.
Severability
If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will continue in full force and effect.
Remedies
The rights and remedies available to 30DayMCAT.com under these Terms and Conditions are cumulative and do not limit any other rights or remedies available under applicable law.
Binding Effect
These Terms and Conditions are binding upon and inure to the benefit of you and 30DayMCAT.com, as well as each party’s respective successors and permitted assigns.
Entire Agreement
These Terms and Conditions constitute the entire agreement between you and 30DayMCAT.com regarding your use of the website and Services and supersede any prior or contemporaneous communications or understandings.
Certain Services may be subject to additional terms and conditions, which will be disclosed to you at the time of enrollment or purchase.
